NEWS The Montgomery Advertiser -Journal Montgomery, Sunday, Aug. 4, 1968 E. C. (Bud) GENEVA, Ala. State Politician, (Bud) Boswell, long a power in Alabama Democratic circles, is dead.

The 84-year-old Boswell was stricken by an heart attack Friday in where apparent! he had practiced law since 1921. He died several hours later in a Geneva hospital. In 1945, Boswell introduced the so-called "Boswell Amendment" to the state constitution. It was struck down by the U.S. Supreme Court in 1949 on grounds that the amendment discriminated against Negroes.

The amendment required tential voters to be able to "understand and explain" any section of the U.S. Constitution to the satisfaction of the county Board of Registrars. Boswell was attorney for the State Alcoholic Beverage Control Board annd later legal adviser during former Gov. James E. Folsom's second administration.

He was chairman of the Geneva County Democratic Executive Committee from 1923 until his death. He was one of the Alabama delegates who walked out of the 1948 Democratic national convention in a dispute over the party's civil rights platform. He also served three terms in the Alabama House of Representatives and was the Geneva County attorney for 42 years. As recently as Jan. 1, 1968, Boswell was named a legislative agent.

The agents represent the interests of counties which do not have a resident member of the legislature. However, they have no vote in the House. At the time of his death, Boswell's appeal of his 1964 disbarment on a quickie divorce charge was still before the State Supreme Court. Survivors include the widow, Mrs. Bertha W.

Boswell; eight daughters, Miss Lula Boswell, Mrs. Eunice Hendri, Mrs. Eliza- Boswell, Dies Jones, Mrs. Carrie YarMrs. Robbie C.

Driver brought, Jean Brannon, all of Geneva, and Mrs. Bertha Bland and Mrs. Agnes Cullifer, both of Ozark; and one son, Ed Boswell, the Geneva County district attorney. Funeral services are scheduled at 4 p.m. Sunday at Geneva's First Methodist Church with burial in Sunset Memorial Home Gardens.

Challenge Of Signatures To Be Heard BOSTON (AP) The state ballot law commission will take no action until least Aug. 9. on any challenge to papers seeking to place third party presidential candidate George C. Wallace on the Massachusetts ballot, Commission Chairman Everett S. Stivers said Friday.

Stivers explained that the commission will be hearing protests against, potential candidates state offices until by Friday we might be able to get any Wallace protests," Stivers said. "If not Friday, then during the week of Aug. 12." Joseph G. Dever of Newton, a candidate for Congress, filed a challenge to the former Alabama governor's nomination papers, charging many of the signatures of the Wallace papers "are fraudulent, spurious, in accurate and should not be certified." Call Hodges, 263- 3256. 20 Automobiles- -Domestic A ANAHEIM BI -AP Wirephoto Anna the Elephant Is Surrounded by Girls With Nixon Hats Convention Like A Circus With Elephants, Sideshows MIAMI BEACH, Fla. (AP) Outside the main tent of Convention Hall, the circuslike sideshow of the GOP national convention is lake an elephant joke set to music. An orange elephant tramples petunias in the Fontainebleau Hotel patio.

A dancing elephant from Disneyland, jungle gray, struts her bit in Richard M. Nixon's roadshow rally. Nelson A. Rockefeller's elephant, caged on Collins Avenue, munches marshmallows. A 40-foot orange rubber elephant filed with helium floats 100 feet above Convention Hall.

A flower -covered pachyderm stands guard below. Nearby an alligator wrestler manhandles an eight-foot 'gator while a model bends her pretty knees near its jaws for a picture. The Rev. Ralph David Abernathy said planned to round out the menagerie with his "poor people's mule train." Go-go girls, a stilt walker, a man soaring, a huge balloon over and Ronald Reagan's three-screen movie add to the unreal air of a city that already called itself "sun and fun capital of the world." Refreshments flow freely in hospitality rooms, some of which begin moving even before -it's time to leave. Many of them are in houseboats worth upwards of $200,000 moored on Indian Creek across Collins Avenue from hotel row.

But not all of the entertainment is free. About 2,500 guests -at $500 a head or $5,000 a table chargeable to American Express credit cards if you likeare expected for the 1968 GOP Gala Sunday night in the Fontainebleau Hotel, headquarters for the convention. That party will spill into the three main rooms of the oceanfront luxury hotel. Guests will dine on boned breast of capon with artichoke bottoms and asparagus tips and dance to the music of Lester Lanin's orchestra. Two hundred live orange trees borrowed from Central Florida groves and hung with 80,000 oranges dangling from wire hooks decorate the main ballroom.

"Bash, son of Gala," for those who can't afford $500, will be held at the same time by Young Republicans at $5 each. Other parties include Sen. Everett Dirksen's soiree for senators and their wives Tuesday night and the youth blast for sons and daughters of delegates Monday night hosted by Patricia and Julie Nixon and David Eisenhower, Julie's fiance. Not all of the musicians are as chic as Lanin's society orchestra. A native steel band from Trinidad is here for atmosphere.

The Eureka Marching Band of New Orleans is on tap for a Nixon rally scheduled to travel from hotel to hotel. There's also a choir of 36 girl singers and the Nixon Navy, a flotilla of small boats to carry banner and take delegates for sightseeing rides. "I think we're outblitzing Rocky in that respect," said a Nixon aide, Ralph Paladino. Rockefeller headquarters was secretive on plans to generate excitement. Both major candidates have gaggles of pretty girls, most of them too young to vote, outfitted in uniform.

The Rockyettes and Nixonairs greet influential Republicans like Michigan Gov. George Romney with kisses. One of the Nixon troops is Gretchen Roosevelt, 16, granddaughter of President Franklin Delano Roosevelt. Gretchen's father, Elliott, former mayor of the host city and a prime mover in recruiting the convention here, is national Democratic committeeman from Florida and ticketless during the convention. For Fund-Raising Party Orange Hangers GOP's Busiest MIAMI BEACH, Fla.

(AP) The busiest Republicans in Miami Beach Saturday were the volunteer orange hangers. Orange hangers? They are a rare species of publican indigenous to Florida generally hibernate for fourand Southern California. They year periods or longer, if presidential nominating conventions are not being held in their territory. They emerge before big fundraising parties, like the $500-a- plate GOP Gala being at the Fontainebleau Hotel Sunday night for between 2,000 and 2,500 party members. The species has been working furiously sticking wires, into thousands of oranges hanging the oranges like Christmas tree ornaments from 200 trees that decorate the Grand Ballroom, of the Gala.

It doesn't do the oranges much good, of course, but the Republicans expect the Gala to do them a great deal of goodlike about $1 million worth for the Republican National Committee, the Republican National Congressional Committee and the Republican National Senatorial Committee. is strictly a fun party, no political speeches," promised George Murphy, erstwhile tap dancer, now a U.S. senator from California. The Gala is scheduled for 7 p.m. with a reception followed by an 8 p.m.

dinner among the newly adorned trees. The trees, valued at $4,500 wholesale, were brought here, alive, from Dade City, 500 miles away, two refrigerated vans that made seven round trips each. When the party ends, the trees will be given to charity. The oranges will be thrown out. Just how many oranges there will be is a point of dispute.

The Florida Citrus Commission says 80,000. Other estimates say there are half that many. It doesn't really matter. It seems unlikely that anybody is going to count. James Griffin of Tampa, chairman of decorations, said the birds would be free to fly during dinner, added, a little hopefully, "They probably won't." He confided to a news conference Saturday that the birds "were brought from a secret place in the jungles of Costa Rica at the height of the rainy season while their plumage is just right and their voice in tune." Entertainment for the dinner will be supplied by the Lester Lanin Orchestra, Manny Har- mon and his orchestra, Art Linkletter, Anita Bryant, Tony Martin, Eloise Laws and the Step Brothers, described by Murphy as "the wonderful fellows who taught me to dance when I was Shirley Temple's age." If $500 a seat or $5,000 for a 10-seat table is a bit steep for the guests, the Gala's sponsors say they'll let the guests charge it on a major credit card. There will be no head table. So the question naturally came up: Where will Richard M.

Nixon be seated in relation to Nelson A. Rockefeller? C. Langhorne Washburn, chairman of the financial committee, conceded, "They would have to be on opposite sides of the dance But perhaps no one told him: Nixon isn't scheduled to arrive here until Monday. Convention Situation Fluid, Republican Leader Claims MIAMI BEACH, Fla. (AP)House Republican Leader Gerald R.

Ford, who will preside over the Republican National Convention, called the situation fluid" Saturday and gested five or six ballots may be needed to pick a presidential nominee. The Michigan congressman, who maintained his strict neutrality in the contest, said he found upon his arrival here "a very fluid situation at the moment with a great deal of uncertainty. think it is a very great possibility that there will be more than one ballot and I wouldn't rule out the possibility there will be five or six ballots," Ford told reporters. Asked if he would be willing to accept the party's vice presidential nomination, for which he was mentioned eight years ago, Ford said "categorically and unequivocally no. I have not been asked and I don't expect to be asked." He said his future lies in the House where he hopes to be speaker next year.

He predicted Republicans would pick up at least 40 seats -nine more than the number they need to take control. But the Michigan congressman did say he hopes those of the party's presidential candidates who lose the nomination will consider taking the No. 2 spot. "I don't think any candidate should say 'no' except myself," he said. Ford said that when he speaks to the convention Tuesday night "I hope to say something that none of the others will say" but declined to give details.

He said he expects to preside over an orderly convention, adding he thinks it will compare favorably with the Democratic convention later this month in Chicago where he said "the basic decision has already been made."
